DMCA Policy
Homemade Waffles ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at https://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Homemade Waffles website or other online services (the "Site") if such claims are reported to our Designated Copyright Agent.
This policy outlines the information that should be present in a notice of alleged copyright infringement and a counter-notice. We reserve the right to remove content without prior notification and without liability, at our sole discretion.
Filing a Notice of Copyright Infringement
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Homemade Waffles Site, please provide the following information in writing to our Designated Copyright Agent:
- Identification of the copyrighted work claimed to have been infringed: A detailed description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, please provide a representative list of such works.
- Identification of the infringing material: A description of the material that you claim is infringing and where it is located on the Homemade Waffles Site (e.g., a specific URL link to the allegedly infringing content).
- Your contact information: Your full legal name, mailing address, telephone number, and email address.
- A statement of good faith belief: A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- A statement under penalty of perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Your physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Filing a Counter-Notification
If you believe that the material you posted on the Homemade Waffles Site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent by providing the following information in writing:
- Identification of the removed material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., a specific URL link).
- A statement of good faith belief: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your contact information: Your full legal name, mailing address, telephone number, and email address.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Homemade Waffles may be found, and that you will accept service of process from the person who provided the original notification of infringement.
- Your physical or electronic signature: Your physical or electronic signature.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability.
